Thank you for your e-mail which was received at the Commission.

The Commission was set up in accordance with the Criminal Appeals Act 1995. This statute provides the Commission with the power to refer criminal cases back to the Court of Appeal where there is a real possibility that the conviction or finding would be overturned or the sentence reduced if the case was sent back to them. This will usually involve finding new evidence which would have been admissible in the previous proceedings and where the failure to adduce that evidence in those earlier proceedings can be reasonably explained.

Ms Yewa Holiday, Case Review Manager, is in the process of reviewing Mr Ram’s conviction. The Commission is in contact with Mr Ram and his representatives and keeps them regularly updated. The Commission is currently waiting for further representations to be made by Mr Ram’s solicitors. These will then be fully considered by a committee of three Commission Members who will make the decision whether or not to refer the case to the Court of Appeal.
